Last Updated: July 21, 2026
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS. FOR EXAMPLE, THEY INCLUDE RESTRICTIONS ON THE USE OF THE PRODUCTS, DISCLAIMERS OF WARRANTIES, LIMITS ON LIABILITY AND INDEMNIFICATION OBLIGATIONS. WHEN YOU PLACE AN ORDER OR BUY ANY PRODUCT FROM SIMPLE PEPTIDE, YOU CONFIRM THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS. YOU ALSO AGREE TO BE BOUND BY THEM.
PART I — PURCHASE AGREEMENT
1. Introduction and Acceptance
This Purchase Agreement and the Website Terms and Store Policies in Part II together form this “Agreement”. It governs the purchase and sale of all products and services that Simple Peptide offers through https://simplepeptide.com (the “Site”). In this Agreement, “Simple Peptide”, “we”, “us” and “our” mean Simple Peptide. Likewise, “Buyer” and “you” mean the customer who buys or obtains products.
This Agreement sets the conditions and restrictions for the sale and purchase of the Material. When you place an order through the Site, create an account, or otherwise buy or obtain any Material, you agree to be bound by this Agreement. If you do not agree, you may not order or obtain any Material. We may revise this Agreement at any time, at our sole discretion, by posting an updated version on the Site. The revised terms take effect on the “Last Updated” date. After that date, your continued use of the Site or your new orders mean you accept the revised terms.
2. Definitions
In this Agreement, the following terms have these meanings:
- “Material” means any product or service that Buyer buys or obtains from Simple Peptide. For example, it includes, without limitation, peptides, proteins, liquids, powders, chemicals, reagents, labware and hardware.
- “Affiliate” means any entity that controls Simple Peptide, that Simple Peptide controls, or that shares common control with Simple Peptide. It also includes the officers, directors, employees, agents and representatives of each such entity.
- “Qualified Researcher” means a person who is at least twenty-one (21) years old. In addition, this person has the professional training, technical skills and facilities needed to handle, store and use the Material safely and lawfully for Research Purposes.
- “Research Purposes” means genuine in vitro laboratory research, analysis and development work by qualified personnel. However, Research Purposes expressly exclude any clinical, diagnostic or human-subject research. They also exclude any use in or on the human or animal body.
- “Order” means a request from Buyer to buy Material through the Site.
3. Research Use Only; No Human or Animal Consumption
3.1. We sell all Material on the Site FOR LABORATORY AND RESEARCH USE ONLY. THE MATERIAL IS NOT FOR HUMAN OR ANIMAL CONSUMPTION OF ANY KIND. ALSO, IT IS NOT A DRUG, FOOD, DIETARY SUPPLEMENT, MEDICAL DEVICE OR COSMETIC.
3.2. The U.S. Food and Drug Administration has not evaluated the statements on the Site. Therefore, neither the Material nor any statement about it is meant to diagnose, treat, cure or prevent any disease or medical condition.
3.3. Basic scientific research does not include any clinical, diagnostic or human research. As a result, you may not use the Material, for example: (a) for human or animal consumption; (b) as or in a food, drug, dietary supplement, medical device or cosmetic for humans or animals; (c) for in vitro diagnostic purposes; or (d) for any commercial purpose, except as Section 6 expressly allows.
3.4. Buyer agrees not to use the Material for any human or animal consumption. Buyer also agrees that the Material is for Qualified Researchers only.
4. Regulatory Status of Simple Peptide
Simple Peptide is a chemical supplier. It is not a compounding pharmacy as described in Section 503A of the Federal Food, Drug, and Cosmetic Act (the “FDCA”). Nor is it an outsourcing facility as described in Section 503B of the FDCA. In addition, Simple Peptide does not compound drugs or dispense drugs under a prescription. Finally, Simple Peptide does not make, market or sell the Material for use in the diagnosis, cure, mitigation, treatment or prevention of disease.
5. Eligibility and Age Requirement
5.1. You must be at least twenty-one (21) years old to buy Material through the Site. When you place an Order, you confirm and warrant that you are at least twenty-one (21) years old. You also confirm that you are a Qualified Researcher or that you buy on behalf of one. Finally, if you order for an entity, you confirm that you have authority to bind that entity to this Agreement.
5.2. Simple Peptide may ask for proof of age, professional qualification or institutional affiliation. In addition, Simple Peptide may refuse, limit, suspend or cancel any Order or account if it believes, at its sole discretion, that you do not meet these eligibility requirements. The same applies if it believes the information you gave is false, incomplete or misleading.
6. Permitted Use and License
Subject to this Agreement, Simple Peptide gives Buyer a limited, non-exclusive, non-transferable and revocable right to use the purchased quantity of Material. Buyer may use it only for internal Research Purposes and only for the benefit of Buyer. However, this Agreement gives no right to resell the Material or any of its parts, whether expressly, by implication or by estoppel. In short, the Material is for internal Research Purposes only. For example, you may not use it in any commercial application, including quality control or commercial services such as reporting your results for a fee or other payment.
7. Restrictions on Use and Transfer
7.1. Buyer will not, directly or indirectly: (a) use the Material for any purpose other than Research Purposes; (b) resell, repackage or relabel the Material, or use it as a starting material or part of another product; (c) export or re-export the Material; or (d) give the Material to any third party, except as Section 7.2 allows.
7.2. Buyer may plan to sell, supply, repackage or relabel the Material, use it as a starting material or part, or otherwise give it to a third party. In that case, Buyer must first record the identity of the third party. Next, Buyer must send that information to Simple Peptide for review and approval. In short, Buyer must get express written approval from Simple Peptide before giving any Material to any third party.
7.3. Simple Peptide may limit the quantity of Material it sells to any customer. It may also decline to sell Material to any customer it considers unqualified, at its sole discretion.
8. Buyer Representations and Warranties
Buyer confirms and warrants to Simple Peptide that:
8.1. Through its own independent review and study, Buyer fully understands: (a) the health and safety hazards of handling the Material; (b) the industrial hygiene controls it needs to protect its workers and personnel from those hazards; (c) the need to give adequate warnings about the health and safety hazards of the Material; and (d) the government regulations on the use of, and exposure to, the Material.
8.2. Buyer will properly test and use any Material it buys from Simple Peptide. The same applies to any materials Buyer makes with that Material. In both cases, Buyer will follow the practices of a reasonable expert in the relevant scientific field. Buyer will also strictly comply with all applicable federal, state and local laws and regulations, whether they exist now or take effect later.
8.3. Only Qualified Researchers and other qualified, trained individuals will handle the Material.
9. Regulatory Compliance by Buyer
9.1. Buyer warrants that any materials it makes with Material from Simple Peptide will not be adulterated or misbranded within the meaning of the FDCA. Buyer also warrants that those materials will not be articles that Sections 404, 505 or 512 of the FDCA bar from interstate commerce.
9.2. Buyer understands that the Material may not appear on the Toxic Substances Control Act (“TSCA”) inventory, because it is mainly for Research Purposes. Therefore, Buyer takes responsibility for making sure that TSCA allows the use of the Material, if and to the extent TSCA applies. Buyer also takes responsibility for getting separate authorization for any use outside the TSCA research-and-development exemption.
9.3. Buyer alone is responsible for complying with all export-control laws and regulations. Accordingly, Buyer will not export or re-export the Material in violation of those laws.
10. Hazard Acknowledgment and Duty to Warn
Buyer understands that handling and using the Material involves hazards. Therefore, Buyer must verify these hazards and do any further research needed to learn them. Buyer must also warn its own customers and any support personnel, such as freight handlers, about any risks in using or handling the Material. Finally, Buyer agrees to follow any instructions from Simple Peptide about the use of the Material and agrees not to misuse the Material in any way.
11. DISCLAIMER OF WARRANTIES
11.1. WE PROVIDE THE MATERIAL “AS IS” AND “WITH ALL FAULTS.” SIMPLE PEPTIDE HAS NOT TESTED THE MATERIAL FOR SAFETY OR EFFICACY IN FOOD, DRUG, MEDICAL DEVICE, COSMETIC, COMMERCIAL OR ANY OTHER USE.
11.2. TO THE FULLEST EXTENT THE LAW ALLOWS, SIMPLE PEPTIDE MAKES NO WARRANTIES OF ANY KIND ABOUT THE MATERIAL, WHETHER EXPRESS OR IMPLIED. IN PARTICULAR, SIMPLE PEPTIDE DISCLAIMS ANY (A) WARRANTY OF MERCHANTABILITY; (B) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; AND (C) WARRANTY AGAINST INFRINGEMENT OF ANY THIRD PARTY’S INTELLECTUAL PROPERTY RIGHTS. THIS DISCLAIMER APPLIES WHETHER THE WARRANTY ARISES BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE.
11.3. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. SO, SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
12. LIMITATION OF LIABILITY
12.1. IN NO EVENT WILL SIMPLE PEPTIDE OR ANY OF ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES. LIKEWISE, THEY WILL NOT BE LIABLE FOR ANY LOST PROFITS, LOST REVENUES OR DIMINUTION IN VALUE. THIS APPLIES TO ANY CLAIM THAT ARISES OUT OF OR RELATES TO THIS AGREEMENT OR THE MATERIAL, WHETHER BASED IN CONTRACT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER THEORY. IT ALSO APPLIES EVEN IF SIMPLE PEPTIDE KNEW SUCH DAMAGES WERE POSSIBLE OR THE DAMAGES WERE FORESEEABLE.
12.2. SIMPLE PEPTIDE’S TOTAL LIABILITY FOR ALL CLAIMS THAT ARISE OUT OF OR RELATE TO THIS AGREEMENT OR ANY MATERIAL WILL NOT EXCEED THE AMOUNT BUYER ACTUALLY PAID FOR THE MATERIAL THAT GAVE RISE TO THE CLAIM.
12.3. However, nothing in this Agreement excludes or limits any liability that applicable law does not allow us to exclude or limit. For example, this includes liability for death or personal injury caused by gross negligence or willful misconduct.
13. Indemnification
Simple Peptide would not otherwise sell the Material to Buyer. So, in return for this sale, Buyer agrees to indemnify, defend and hold harmless Simple Peptide and its Affiliates. This covers any and all claims, demands, actions, suits, proceedings, investigations, losses, damages, fines, penalties, liabilities, costs and expenses of any kind, including reasonable attorneys’ fees. In particular, it covers anything that arises out of or relates to: (a) Buyer’s handling, storage, testing, use or disposal of any Material, whether alone or combined with any other substance, and whatever the Material’s origin; (b) Buyer’s breach of this Agreement or of any representation or warranty in it; (c) Buyer’s violation of any applicable law or regulation, including the FDCA, TSCA and export-control laws; (d) any regulatory action that arises from Buyer’s activities; and (e) Buyer’s sale, supply or transfer of the Material to any third party.
14. Intellectual Property and No Patent License
14.1. Simple Peptide does not warrant that the use or sale of the Material will not infringe any United States or foreign patent. This applies to patents on the Material itself, on its use with other material, or on its use in any process. Also, listing any Material on the Site is neither a license for, nor a recommendation of, any use that infringes a patent.
14.2. The sale of Material grants no license, express or implied, under any patent, trademark, copyright or other intellectual property right of Simple Peptide. The only exception is the limited right of use in Section 6. Between the parties, however, Buyer owns the research data and results it creates through its own permitted use of the Material.
15. Governing Law
The laws of the State of Florida govern this Agreement and any dispute that arises out of or relates to it or the Material. These laws apply without regard to Florida’s conflict-of-laws principles. In addition, the United Nations Convention on Contracts for the International Sale of Goods does not apply.
16. Dispute Resolution; Venue
16.1. Venue. The parties agree to bring any action or proceeding that arises out of or relates to this Agreement only in the state or federal courts in Palm Beach County, Florida. In addition, each party consents to the personal jurisdiction of those courts.
16.2. Fees. In any action that arises out of or relates to this Agreement, the winning party may recover its reasonable attorneys’ fees, filing fees and costs, to the extent applicable law allows.
16.3. Consumer reviews. Nothing in this Agreement restricts, prohibits or penalizes any lawful review, feedback or assessment by Buyer of Simple Peptide or the Material. Simple Peptide keeps only the rights the law preserves. For example, it may remove content that is unlawful, defamatory, or clearly false or misleading, and it may pursue any available claim for defamation.
17. General Provisions
17.1. Entire Agreement. This Agreement, any order confirmation and the Privacy Policy together form the entire agreement between the parties on this subject. As a result, they replace all earlier understandings and agreements, whether written or oral.
17.2. Amendment; No Waiver. A change to this Agreement between the parties takes effect only if it is in writing and both parties sign it. The only exception is that Simple Peptide may update these posted terms as Section 1 describes. Also, if Simple Peptide fails or delays to use any right, that is not a waiver. Likewise, a single or partial use of any right does not prevent any further use of it.
17.3. Severability. A court of competent jurisdiction may find a provision of this Agreement illegal, invalid or unenforceable. In that case, that provision will be limited or removed only as much as necessary. Meanwhile, the remaining provisions stay in full force and effect.
17.4. Assignment; Successors. Buyer may not assign this Agreement without the prior written consent of Simple Peptide. In addition, this Agreement binds and benefits the parties and their permitted successors and assigns.
17.5. Force Majeure. Simple Peptide is not liable for any delay or failure to perform that results from causes beyond its reasonable control. For example, these causes include acts of God, natural disasters, labor disputes, supply shortages, carrier delays, government action, or failures of third-party service providers.
17.6. Notices. Send notices to Simple Peptide at info@simplepeptides.us or at 6586 W Atlantic Ave, Ste #1112, Delray Beach, Florida 33446. Likewise, we may send notices to Buyer at the email or postal address linked to Buyer’s account or Order.
17.7. Relationship of the Parties. The parties are independent contractors. Therefore, nothing in this Agreement creates any partnership, joint venture, agency or employment relationship. Nor does it create any contract or arrangement for research or product development, or any transfer, license or purchase of technology, other than as this Agreement expressly states.
17.8. Headings. Headings are for convenience only, so they do not affect the meaning of this Agreement.
PART II — WEBSITE TERMS AND STORE POLICIES
18. Copyright and Trademark Notice
Unless we state otherwise, Simple Peptide solely owns all materials on the Site, Copyright ©, All Rights Reserved. This includes text, site design, logos, graphics, icons and images, as well as their selection, assembly and arrangement. You may use the content of the Site only to shop on the Site or place an Order, and for no other purpose. Also, you may not copy, reproduce, modify, republish, upload, post, transmit or distribute any materials from the Site in any form or by any means without our prior written permission. We reserve all rights that we do not expressly grant. In fact, any unauthorized use of the materials on the Site may violate copyright, trademark and other applicable laws.
19. Order Acceptance Policy
An electronic or other order confirmation does not mean that we accept your Order. Nor does it confirm our offer to sell. Instead, your Order is an offer to buy, and all Orders depend on our acceptance. At any time after we receive your Order, we may accept or decline it for any reason, at our sole discretion. We may also supply less than the quantity you ordered of any item. In short, any confirmation email only confirms that we received your Order.
20. Pricing and Typographical Errors
Prices may change without notice. We charge the price shown on the Site at the time you place the Order. However, a product may show an incorrect price because of a typographical error or an error in pricing information. In that case, Simple Peptide may refuse or cancel any Orders for that product at the incorrect price. This applies whether or not we confirmed the Order and charged your payment method. If we already charged your payment method and then cancel your Order, Simple Peptide will refund the incorrect price we charged.
21. Payment and Credit Cards
We accept credit cards and the other payment methods shown at checkout. Please give your exact billing address and telephone number, as your card issuer has them on file. Otherwise, incorrect information may delay your Order. You also confirm and warrant that your payment information is true, correct and complete, and that you may use the payment method. Your card statement will show purchases as “SimplePeptide.com.” In addition, we may add a card-processing fee to your Order and will show it at checkout.
22. Shipping Policy
We ship most Orders that we receive before 2:00 p.m. EST on the same business day, as long as the product is in stock. However, we do not process or ship Orders on Saturday, Sunday or holidays, unless we arrange it in advance. We cannot guarantee when an Order will arrive. Any shipping or transit time is only an estimate, and we are not liable for shipping delays. Unless the order confirmation states otherwise, Buyer pays all shipping and handling charges. Also, title and risk of loss pass to Buyer when we hand the products to the carrier.
23. Out-of-Stock Products; Backorders; Cancellation
We will ship your product as soon as it is available. If a product you ordered is out of stock, your Order may take longer, and we will keep you informed. Also, you may cancel your Order at any time before it ships.
24. Returns and Refunds
Because of the nature of the Material, the Site may mark certain products as non-returnable. For all other products, we accept returns for a refund of the purchase price, minus the original shipping and handling. To qualify, you must return the product within thirty (30) days of delivery with valid proof of purchase. In addition, the Material must be unopened and in its original condition. To return a product, first contact us at info@simplepeptides.us for a Return Merchandise Authorization (“RMA”) number. We do not accept any return without an RMA number. You pay for return shipping, and you bear the risk of loss during return shipment. Finally, we offer no refunds on products marked as non-returnable.
25. Taxes
We automatically charge and collect applicable sales tax on Orders that we deliver to any state or jurisdiction where Simple Peptide has a presence or must otherwise collect tax. For Orders that we ship elsewhere, however, you alone are responsible for any sales or other taxes that may apply.
26. SMS / Text Message Terms
26.1. Opt-in and consent. You may opt in to SMS messages from Simple Peptide, for example by checking the SMS consent box or by giving your mobile number for that purpose. When you do, you give your prior express written consent to receive recurring automated text messages from Simple Peptide at that number. These messages may include marketing, promotional offers, product updates and related communications, and we send them with automated dialing technology.
26.2. Not a condition of purchase. You do not need to agree to marketing text messages to buy any goods or services from Simple Peptide.
26.3. Rates and frequency. Message and data rates may apply. In addition, message frequency varies.
26.4. Opt-out and help. You may withdraw your consent at any time by replying STOP to any message. You may also reply “unsubscribe”, “cancel”, “end”, “quit”, “opt out” or “revoke”. We will honor opt-out requests promptly and, in any event, within ten (10) business days. For help, reply HELP or contact us at info@simplepeptides.us. Also, we do not require any single method for opting out.
26.5. Delivery. Simple Peptide may send SMS messages from a dedicated toll-free or short-code number. This number may differ from the customer-support number on the Site. Neither Simple Peptide nor the wireless carriers are liable for delayed or undelivered messages. Finally, our Privacy Policy also applies to your use of SMS messaging.
27. Privacy
We collect and use personal information to process and fulfill your Orders, talk with you about your purchases and personalize your experience. This information includes your name, email address, payment information, address, phone number and account credentials. We also take reasonable steps to keep this information secure. Depending on your state, you may have rights to access, correct or delete your personal information, or to opt out of certain data practices. Our Privacy Policy fully describes how we collect, use, share and keep data, as well as your consumer rights. In addition, this Agreement includes the Privacy Policy by reference.
28. Third-Party Links
The Site may contain links to third-party websites that Simple Peptide does not own or operate. Simple Peptide is not responsible for how those sites work or for their content. Also, each third-party site has its own privacy policy and data practices, so please read each site’s privacy policy for more information.
29. Platform Notice
WooCommerce powers the online store. While WooCommerce provides the tools to run the store, it is in no way responsible for the activities or content in it. All content on the Site, including products, web copy and promotions, belongs only to Simple Peptide and has no direct ties to WooCommerce. If you have questions about anything in the store, please contact us through the Site’s contact page.
30. Other Conditions
These conditions replace any terms or conditions you include with any purchase order, whether or not Simple Peptide signs them. Simple Peptide may also change the Site and these conditions at any time. Finally, if Part I and Part II conflict, Part I controls the sale and use of the Material.
